Kaverse Privacy Policy
Kaverse's Privacy Policy is designed to help you understand how we collect and use the personal information you decide to share, and help you make informed decisions when using Kaverse, located at http://www.Kaverse.com and its directly associated domains (collectively, "Kaverse" or "Website")
Kaverse.com is (currently) “Beta” software. While Kaverse strives to maintain all of the privacy precautions described herein, the website is not devoid of risk of “bugs” and software faultiness that is common with Beta software. As is made clear in the Terms of Service Kaverse disclaims and limits its liability with respect to such “Beta” software, including limitation of its any liability regarding privacy issues set forth in this policy.
By using or accessing Kaverse, you are accepting the practices described in this Privacy Policy. By using Kaverse, you are also consenting to have your personal data transferred to and processed in the United States. When a Member who is located in the European Union chooses to post Profile Information that will be publicly disclosed, that Member is responsible for ensuring that such information conforms to all local data protection laws. Kaverse is not responsible under the EU local data protection laws for Member-posted information.
Information Covered by the Privacy Policy
When you visit Kaverse you provide us with two types of information:
1) Personal information you knowingly choose to disclose that is collected by us when you register with Kaverse or edit your profile. This personally identifiable information includes data such as your name, your date of birth, your email address, telephone number, address, credit card information, schools attended and any other personal or preference information that you provide to us. Kaverse may also collect personal identifying information (“PII”) from you if you choose to participate in Kaverse activities like contests or surveys, because you want us to furnish you with products, services, newsletters, or information, or in connection with content or suggestions you submit to Kaverse for review.
2) Kaverse uses information collected by it as you interact with our Web Site. This information includes IP address, aggregate user data, and browser type. Kaverse uses this data to manage and improve services, track usage, and for security purposes. Also, when you use Kaverse, you may set up your personal profile, form relationships, send messages, perform searches and queries, form groups, set up events, add applications, and transmit information through various channels. We collect this information so that we can provide you the service and offer personalized features. In most cases, we retain it so that, for instance, you can return to view prior messages you have sent or easily see your friend list. When you update information, we usually keep a backup copy of the prior version for a reasonable period of time to enable reversion to the prior version of that information.
Use of Your Information by Kaverse
Your contact information will never be rented or sold. Other than what you choose to post on your page, your personal information is kept confidential. It will be used for only two purposes:
1) You can choose to display or not display your address and phone number in each OPEN GROUP to which you belong. For Example: You might want it displayed to your family group but not a business group. Contact information other than name and state are not displayed in closed groups.
2) We collect demographic data regarding zip codes, states and ages that help our advertisers to customize the online ads you encounter to those we believe are aligned with your interests. The information used for this feature does not provide your PII or identify you as an individual to third parties.
Search engines may index the portion of a Member’s profile (including the Profile Information it contains) that is publicly displayed.
Kaverse employees, agents and contractors must have a business reason to obtain access to your PII. Kaverse may share your PII with those who help us manage or provide Kaverse's information activities (for example, message board administration, order fulfillment, statistical analyses, data processing), or with outside contractors, agents or sponsors who help us with the administration, judging and prize fulfillment aspects of contests, promotions and sweepstakes.
These outside contractors, agents or sponsors may temporarily store some information on their servers, but they may only use your PII to provide Kaverse with a specific service and not for any other purpose. Kaverse may also provide your PII to a third party in those instances where you have chosen to receive certain information and have been notified that the fulfillment of such a request requires the sharing of your PII. Kaverse also may share your PII with Affiliated Companies if it has a business reason to do so.
There may be instances when Kaverse may access or disclose PII, Profile Information or non-PII without providing you a choice in order to: (i) protect or defend the legal rights or property of Kaverse, our Affiliated Companies or their employees, agents and contractors (including enforcement of our agreements); (ii) protect the safety and security of Users of Kaverse or members of the public including acting in urgent circumstances; (iii) protect against fraud or for risk management purposes; or (iv) comply with the law or legal process. In addition, if Kaverse sells all or part of its business or makes a sale or transfer of all or a material part of its assets or is otherwise involved in a merger or transfer of all or a material part of its business, Kaverse reserves the right to transfer your PII to the party or parties involved in the transaction as part of that transaction. Under those circumstances, it is anticipated that the successor in interest will abide by the terms of this Agreement.
From time to time Kaverse may make changes to its privacy policy. If material changes are made, Kaverse will advise its members by posting that information on its website. A User is bound by such changes when he/she uses the website following the posting of information regarding the changes.
If you ask Kaverse to stop using your PII, Kaverse will honor that request while retaining any record of your PII that is necessary to comply with applicable federal, state or local law.
Use of Your Own Information
Kaverse is not responsible for the disclosure of information posted on your own page, messages posted on the page of another, or information transmitted through the various methods Kaverse offers including, emails and email invitations, instant messages, forums, bulletin boards, chat rooms, etc.
Kaverse Members may also choose to provide or store non-PII information in their profiles, including but not limited to date of birth, interests, hobbies, lifestyle choices, groups with whom they are affiliated (schools, companies), videos and/or pictures, private messages, bulletins or personal statements (collectively “Profile Information”). You post such User Content (as defined in the Kaverse Terms of Use) on the Site at your own risk. Although we allow you to set privacy options that limit access to your pages, please be aware that no security measures are perfect or impenetrable. We cannot control the actions of other Users with whom you may choose to share your pages and information. Therefore, we cannot and do not guarantee that User Content you post on the Site will not be viewed by unauthorized persons. We are not responsible for circumvention of any privacy settings or security measures contained on the Site. You understand and acknowledge that, even after removal, copies of User Content may remain viewable in cached and archived pages or if other Users have copied or stored your User Content.
Cookies
Cookies are small bits of information that Kaverse places on your computer. Kaverse uses cookies to identify your Internet browser, store Users’ preferences, and determine whether you have installed the enabling software needed to access certain material on Kaverse. Data in cookies may be read to authenticate user sessions or provide services.
Third party advertisements displayed on Kaverse may also contain cookies set by Internet advertising companies or advertisers (known as “third party cookies”). Kaverse does not control these third party cookies and Users of Kaverse should check the privacy policy of the Internet advertising company or advertiser to see whether and how it uses cookies. A pixel tag is a tiny image inserted in a webpage and used to record the number and types of views for that page. Kaverse may allow third party pixel tags to be present on Kaverse for purposes of advertising, providing services or data and statistics collection.
You can program your computer to warn you each time a cookie is being sent, block third party cookies or block all cookies. However, by blocking all cookies you may not have access to certain features on Kaverse.
Security
Kaverse takes appropriate precautions to protect our users' information. Your account information is located on a secured server behind a firewall. When you enter sensitive information (such as credit card number or your password), we encrypt that information using secure socket layer technology (SSL). Because email and instant messaging are not recognized as secure communications, we request that you not send private information to us by email or instant messaging services.
All of our users’ information, not just the sensitive information mentioned above, is restricted in our offices. Only employees who need the information to perform a specific job (for example, a customer service representative) are granted access to personally identifiable information. Furthermore, all employees are kept up-to-date on our security and privacy practices and are regularly reminded about the importance we place on privacy, and what they can do to ensure our customers’ information is protected. Finally, the servers that we store personally identifiable information on are kept in a secure environment.
Links to Other Sites
Kaverse may contain links to other websites. We are of course not responsible for the privacy practices of other web sites. We encourage our users to be aware when they leave our site to read the privacy statements of each and every web site that collects personally identifiable information. This Privacy Policy applies solely to information collected by Kaverse.
Children
Kaverse does not knowingly collect or solicit personal information from anyone under the age of 13 or knowingly allow such persons to register. If you are under 13, please do not attempt to register for Kaverse or send any information about yourself to us, including your name, address, telephone number, or email address. No one under age 13 may provide any personal information to or on Kaverse. In the event that we learn that we have collected personal information from a child under age 13 without verification of parental consent, we will delete that information as quickly as possible. If you believe that we might have any information from or about a child under 13, please contact us.
We recommend that minors over the age of 13 ask their parents for permission before sending any information about themselves to anyone over the Internet.
Privacy Policies and Kaverse BETA Version
Kaverse is (currently) “Beta” software. Disputes Under this Agreement
YOU AND KAVERSE AGREE THAT, EXCEPT AS MAY OTHERWISE BE PROVIDED IN REGARD TO SPECIFIC SERVICES ON THE SITE IN ANY SPECIFIC TERMS APPLICABLE TO THOSE SERVICES, THE SOLE AND EXCLUSIVE FORUM AND REMEDY FOR ANY AND ALL DISPUTES AND CLAIMS RELATING IN ANY WAY TO OR ARISING OUT OF THESE TERMS OF USE, THE SITE AND/OR THE SERVICE (INCLUDING YOUR VISIT TO OR USE OF THE SITE AND/OR THE SERVICE) SHALL BE FINAL AND BINDING ARBITRATION, except that: (a) to the extent that either of us has in any manner infringed upon or violated or threatened to infringe upon or violate the other party's patent, copyright, trademark or trade secret rights, or you have otherwise violated any of the user conduct rules set forth above or in the Code of Conduct then the parties acknowledge that arbitration is not an adequate remedy at law and that injunctive or other appropriate relief may be sought; and (b) no disputes or claims relating to any transactions you enter into with a third party through the Kaverse may be arbitrated.
Arbitration under this Agreement shall be conducted by the American Arbitration Association (the "AAA") under its Commercial Arbitration Rules and, in the case of consumer disputes, the AAA's Supplementary Procedures for Consumer Related Disputes ( the "AAA Consumer Rules") (collectively the "AAA Rules"). The location of the arbitration and the allocation of costs and fees for such arbitration shall be determined in accordance with such AAA Rules and shall be subject to the limitations provided for in the AAA Consumer Rules (for consumer disputes). If such costs are determined to be excessive in a consumer dispute, Kaverse will be responsible for paying all arbitration fees and arbitrator compensation in excess of what is deemed reasonable. The arbitrator's award shall be binding and may be entered as a judgment in any court of competent jurisdiction.
To the fullest extent permitted by applicable law, NO ARBITRATION OR CLAIM UNDER THESE TERMS OF USE SHALL BE JOINED TO ANY OTHER ARBITRATION OR CLAIM, INCLUDING ANY ARBITRATION OR CLAIM INVOLVING ANY OTHER CURRENT OR FORMER USER OF THE SERVICE, AND NO CLASS ARBITRATION PROCEEDINGS SHALL BE PERMITTED. In no event shall any claim, action or proceeding by you related in any way to Kaverse or its services (including your visit to or use of the Kaverse and/ or its services) be instituted more than three (3) years after the cause of action arose.
By visiting or using the Site and/or the Service, you agree that the laws of the State of California, without regard to principles of conflict of laws, will govern these Terms of Use and any dispute of any sort that might arise between you and the Company or any of our affiliates. With respect to any disputes or claims not subject to arbitration (as set forth below), you agree not to commence or prosecute any action in connection therewith other than in the state and federal courts of California, and you hereby consent to, and waive all defenses of lack of personal jurisdiction and forum non conveniens with respect to, venue and jurisdiction in the state and federal courts of California.
